San Francisco Age Discrimination

Discrimination laws protect workers over 40

With the aging of the baby boomers coinciding with a downturn in the economy, it is not surprising that an increasing number of older workers feel they are facing age discrimination in San Francisco.  The Age Discrimination in Employment Act (ADEA) and other U.S. and California civil rights laws prohibit discrimination in the workplace against anyone 40 years of age or older.  Unfortunately, that does not mean it never happens.

Civil rights laws prohibit age discrimination in San Francisco in:

  • Hiring
  • Compensating
  • Promoting
  • Training
  • Assigning projects
  • Firing
  • Downsizing

Discrimination laws can protect you

Even policies and practices that seem neutral but impact older workers more than younger workers can constitute discrimination under ADEA.  Another law, the Older Workers’ Benefit Protection Act, makes it illegal for an employer to use your age in determining your:

  • Health insurance
  • Life insurance
  • Disability benefits
  • Retirement benefits
  • Other benefits offered by an employer

Your employer may ask you to waive your ADEA rights in exchange for a severance package or other consideration, and this is perfectly legal.  But the waiver must:

  • Be written and understandable
  • Specifically refer to ADEA rights
  • Not waive any future rights or claims you might have
  • Provide value in exchange
  • Advise you to get independent legal counseling before signing
  • Allow you seven days to revoke the agreement and 21 days to consider and request changes

If you feel you were discriminated against because of your age you should talk to an experienced San Francisco age discrimination lawyer.  Age discrimination is difficult to prove.  You must be able to show that your employer took intentional action based on your age, and that you suffered an adverse effect from that action.
